Notice is given that an application for informal appointment of personal representative has been filed with the Registrar. No will has been presented for probate. The application has been granted.

Notice is also given that the Registrar has informally appointed Kelsey Nehring, whose address is P.O. Box 335, Paynesville, MN 56362 as personal representative of the Estate of the Decedent. Any heir or other interested person may be entitled to appointment as personal representative or may object to the appointment of the personal representative. Unless objections are filed with the Court (pursuant to Minn. Stat. 524.3-607) and the Court otherwise orders, the personal representative has full power to administer the Estate including, after 30 days for the date of issuance of letters, the power to sell, encumber, lease or distribute real estate.

Any objections to the probate of the Will or appointment of the Personal Representative must be filed with this Court and will be heard by the Court after the filing of an appropriate petition and proper notice of hearing.

Notice is also given that (subject to Minn. Stat. 524.3-801) all creditors having claims against the Estate are required to present the claims to the personal representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

Notice is hereby given that an application for informal probate of the Decedent’s Will, dated October 30, 1979, (“Will”) has been filed with the Probate Registrar, and the application has been granted.

Notice is also given that the Probate Registrar has informally appointed Christine L Peterson-Stromgren, 5245 Irving Ave S, Minneapolis, MN  55419 as personal representative of the Estate of the Decedent. Any heir, devisee or other interested person may be entitled to appointment as personal representative or may object to the appointment of the personal representative. Unless objections are filed pursuant to Minnesota Statutes section 524.3-607, and the court otherwise orders, the personal representative has full power to administer the Estate, including, after 30 days from the date of issuance of letters, the power to sell, encumber, lease or distribute real estate.

ORDER FOR REMOVAL OF HAZARDOUS BUILDING AND/OR HAZARDOUS PROPERTY AND BLIGHT AND NUISANCE VIOLATION

In the matter of the hazardous building and/or hazardous property and nuisance violations located at 213 1st St. SW, Henriette, MN 55036, and legally described as follows:

PlD #39.5054.000

Lot 1, Block 17, LESS the South 140 feet thereof;

Lots 2 and 3, Block 17; all in the Townsite of Cornell, Pine County, Minnesota.

Owned by Kathleen M. Doenz and possibly occupied by Bruce Steffen.

WHEREAS, pursuant to Minnesota Statutes and City of Henriette Ordinance 2018, Ordinance of Blight and Nuisance, the City Council of the City of Henriette, having duly considered the matter, finds the below described hazardous building and/or hazardous property and nuisance violations to be illegal for the following reasons:

1. Minnesota Statute 463.15 Subd. 3 defines a hazardous building or hazardous property as “any building or property, which because of inadequate maintenance, dilapidation, physical damage, unsanitary conditions, or abandonment, constitutes a fire hazard or hazard to public safety or health”; and

Minnesota Statute 463.16 states “the governing body of any municipality may order the owner of a hazardous building or property within the municipality to correct or remove the hazardous condition of the building or property or to raze or remove the building.”

2. City of Henriette Ordinance 2018, Ordinance of Blight and Nuisance, Paragraph II, Public Blight and Nuisances Affecting Peace and Safety, 2(B)(C) and (D) read as follows:

Paragraph II, 2(B). In any area, the storage or accumulation of junk, trash, rubbish or refuse of any kind. The term “junk” shall include, but not be limited to, parts of machinery, or motor vehicles, unused stoves or other appliances, household furniture, remnants of carpet or wood, decayed weathered or broken construction material or cast-off material of any kind, whether or not the same could be put to any reasonable use.

Paragraph II, 2(C). In any area, the existence of any structure or part of any structure, which because of fire, wind or other natural disaster or physical deterioration, is no longer habitable as a dwelling or useful for any other purpose which it may have been intended.

Paragraph II, 2(D). In any area, the existence of any vacant dwelling, garage or other outbuilding, unless such building is kept securely locked, windows kept glazed or neatly boarded up and otherwise protected to prevent entrance by vandals.

You are in violation of Minnesota Statute 463 and Paragraph II, 2(B)(C)&(D) of the City of Henriette ordinance of Blight and Nuisance due to the following hazardous conditions and blight and nuisance conditions on the property:

1. The house on the property is caving in and falling down from weather damage and deterioration compromising its structural strength and stability.

2. The house on the property is no longer habitable as a dwelling or useful for any other purpose which it may have been intended.

3. There are windows and doors missing from the house allowing animals and/or rodents to access and infest the home which is an immediate health hazard.

4. The property is overgrown with weeds and other vegetation causing a fire hazard.

5. Accumulation and open storage of various inoperable, non-licensed vehicles.

6. Accumulation and open storage of junk, debris, rubbish and refuse.

7. The property is being used as a dump site for trash, rubbish and other debris. Garbage and other discarded furniture has been left on the property.

WHEREAS, pursuant to the foregoing findings of fact in accordance with Minnesota Statutes and said City of Henriette Ordinance 2018, Ordinance of Blight and Nuisance, the City Council of the City of Henriette hereby orders the owner of record and occupant of the property to remove said violations or bring said property into compliance by completing the following tasks:

Remove the house located on the property in its entirety and remove all junk, vehicles, materials and debris from the City of Henriette.

WHEREAS, the City Council of the City of Henriette further orders that unless action is taken, or an answer is served upon the City of Henriette within twenty (20) days from the date of service of this order, an action for enforcement of this order will be made to the District Court of Pine County, Minnesota.

WHEREAS, the City Council of the City of Henriette further orders that if the City is compelled to take further action herein, all necessary costs expended by the City will be assessed against the real estate concerned and will be collected in accordance with Minnesota Statutes and City of Henriette Ordinance 2018, Ordinance of Blight and Nuisance, Paragraph IV, Recovery of Cost.

WHEREAS, the Mayor, city clerk, city attorney and other officers and employees of the City are authorized to take such action, prepare, sign and serve such papers as necessary to comply with this order and to assess the costs thereof against real estate described for collection along with taxes.

Adopted by the City of Henriette City Council this 14 day of October, 2019.
